Union County is located in the U.S. state of South Dakota. The county was formed in 1862 and named after the union of the American states. The county seat is Elk Point. According to the U.S. Census Bureau of 2016, the county has a population of approximately 14,399 people. According to the U.S. Census Bureau, the county has a total area of 467 square miles of which 461 square miles is land and 6.6 square miles is water. Union County borders the following counties: Lincoln County, South Dakota to the north; Sioux County, Iowa to the northeast; Plymouth County, Iowa to the east; Woodbury County, Iowa to the southeast; Dakota County, Nebraska to the south; Dixon County, Nebraska to the southwest; and Clay County, South Dakota to the west. The primary administrative responsibilities of the County Clerk of Courts Office are as follows:

  • Assisting with requests for information on court procedures, fees, court dates, and forms.
  • Processing passports, assessing and receipting fees.
  • Opening, maintaining, storing and retrieving court files as needed in different types of cases.
  • Processing traffic tickets and other criminal complaints, receipting and disbursing fines, fees, costs, bond and restitution associated with same.
  • Working closely with the public, law enforcement and attorneys in maintaining judges’ calendars of court dates and assisting judges in the courtroom.
  • Summoning and qualifying jurors, assist judge in juror selection process, and authorize payment of jurors.
  • Performing magistrate functions such as setting bond, handling initial appearances, issuing warrants, entering default judgments in small claims cases and performing marriages.

Union County Register of Deeds Office Information

The Register of Deeds is the official county record keeper. The Register of Deeds of the county issues and/or files marriage licenses, birth and death certificates, burial permits, real estate transactions (including deeds, mortgages and mortgage transfers), federal and state tax liens, military discharge records, and business name registrations. In addition, the Register of Deeds is also charged for recording mechanics liens, military discharges, county indigent liens, sheriff’s levies, burials, farm leases, corner records, and bill of sales. Union County Register of Deeds Office has land records that date back to 1864 to present. Birth and death records are from 1905 to present. Marriages are statewide from 1950 to present.

The fee to record deeds, contracts, mortgages, easements, satisfaction, bill of sales, mechanics liens, and leases is $30 per document for the 1st 50 pages then $2.00 a page after 50 pages.

To purchase a copy of any recorded document the fee is $1.00 per page. Certified copies of any of these documents are also provided. The cost of these are $5.00 for the first page and $1.00 each additional page.
