Sully County is located in the U.S. state of South Dakota. The county was formed in 1873 and named after Fort Sully, itself named after General Alfred Sully. The county seat is Onida. According to the U.S. Census Bureau of 2016, the county has a population of approximately 1,373 people. According to the U.S. Census Bureau, the county has a total area of 1,070 square miles, of which 1,007 square miles is land and 63 square miles is water. Sully County borders the following counties: Potter County to the north; Hyde County to the east; Hughes County to the south; Stanley County to the southwest; and Dewey County to the northwest. The primary administrative responsibilities of the County Clerk of Courts Office are as follows:

  • Assisting with requests for information on court procedures, fees, court dates, and forms.
  • Processing passports, assessing and receipting fees.
  • Opening, maintaining, storing and retrieving court files as needed in different types of cases.
  • Processing traffic tickets and other criminal complaints, receipting and disbursing fines, fees, costs, bond and restitution associated with same.
  • Working closely with the public, law enforcement and attorneys in maintaining judges’ calendars of court dates and assisting judges in the courtroom.
  • Summoning and qualifying jurors, assist judge in juror selection process, and authorize payment of jurors.
  • Performing magistrate functions such as setting bond, handling initial appearances, issuing warrants, entering default judgments in small claims cases and performing marriages.

    The County Register of Deeds Office is also known as the library of local records. This office is a storage facility for a host of local documents that range from land title transfers to birth, marriage and death records. This office also files state, federal and county liens, mechanic’s liens, business names registrations, UCC liens, military discharge records and other types of miscellaneous filings. Most of these documents are public and widely requested by the general public for inspection. In addition, the register of deeds office is a vital resource for people trying to discover their family tree.

    Recording Fees

    Fees charged by the Register of Deeds Office are generally set by the state legislature, and the monies collected are deposited into the county general fund.

  • Recording deeds, mortgages and all other instruments are $30.00 first 50 pages and $2.00 each additional page.
  • Certified copy of any instrument of record, including certificate and official seal are $5.00 first pages and $1.00 each additional page.
  • Uncertified copy can be obtained for $1.00 per page.
  • Birth, death and marriage certificates can be obtained for $15.00.
  • Filing and indexing a bill of sale, seed grain lien, or thresher’s lien are $30.00 first 50 pages and $2.00 each additional page.
  • Oil, gas and mineral leases, and other documents relating to these areas are $30.00 first 50 pages and $2.00 each additional page.
  • Military Discharges are available for free.
